The agreement for using Nightleg. Short, because the main points are short.

Who these are with

These terms are between you and NightLeg LLC, who runs Nightleg (nightleg.com and the Nightleg iPhone app). By using Nightleg you agree to them. Questions: [email protected].

Nightleg is not an emergency service

Do not rely on Nightleg for safety. Positions can be late, missing or wrong, phones lose signal, and arrival times are estimates. If someone may be in danger, contact the race organizers or emergency services. When a Garmin tracker sends an SOS, Nightleg shows it to the crew, but we do not contact anyone or send help.

Tracking only with permission

Only track people who have agreed to it. Each person turns sharing on from their own phone, and a satellite tracker should be linked only with the knowledge of the person carrying it. Don't use Nightleg to follow anyone who hasn't agreed.

Your race and its links

The person who sets up a race is responsible for it and for who gets its links. Anyone with the crew link or code can see where people are and change the race; anyone with the family link can watch and post cheers. Share them accordingly, and tell us if a link has gone to the wrong person.

Paying

• One race is $29. A year of races is $59, paid once, and covers races set up in the 12 months after payment. It does not renew.
• Payment is taken by Stripe. A race goes live when it is paid for, or when a valid promo code is used.
• Refunds: ask before your race starts and we'll refund it in full. After the start, payments aren't refunded. A year of races is refundable in full until its first race starts.
• Prices can change; a change never affects a race or year already paid for.

What you post

Cheers, photos and voice notes stay yours. You let us store them and show them to the race's crew and family, which is all we use them for. Don't post anything unlawful, or anything you don't have the right to share.

Fair use

Don't try to break, overload or get around the protections in Nightleg, open races that aren't yours, or use it to harass anyone. We may suspend a race or account that does.

No guarantees

We work hard to keep Nightleg running and accurate, but it is provided as it is, without warranties of any kind. Tracking depends on phones, satellites and networks outside our control.

Limit of liability

As far as the law allows, we are not liable for indirect or consequential losses, or for anything that results from a position, time or alert being late, missing or wrong. Our total liability for any claim is limited to what you paid us for the race concerned.

Ending

You can stop using Nightleg at any time and ask us to delete your races. We may end access for anyone who breaks these terms.

Changes and law

We may update these terms; the date above will change, and for big changes we'll tell race owners by email. These terms are governed by the laws of North Carolina, United States.
